Terms of sale
These terms apply to every sale of a work made on this website. They are available at all times and are shown to you, with a checkbox, before any reservation. The French version prevails.
1. The seller

2. The works
Every work offered is a unique original work, made by the artist's own hand. Its page gives its title, medium, support, dimensions and, where relevant, its framing. Photographs are as faithful as possible; depending on your screen settings, slight differences in colour may exist with the actual work. The “see it framed” preview is only an illustration: the frames shown are not sold on this website.
3. Prices
Prices are in euros, all taxes included; TVA non applicable, art. 293 B du CGI. Shipping costs are added to the price of the work: the artist confirms them to you in writing before any payment. Hand delivery, where offered, involves no shipping costs.
4. Reserving, then buying
A sale takes place in two steps.
- Reservation: you choose one or more works, enter your details and how you would like to receive them, accept these terms, then reserve. A reservation commits you to nothing and costs nothing: the work is set aside for you for the period shown when you reserve. An email confirms it straight away.
- Confirmation: within that period, the artist confirms by email the total price, shipping included, and how to pay. She may also decline (for instance if the work has been sold elsewhere in the meantime): you are then informed and nothing is asked of you.
The sale is concluded when you pay. Before paying, you can check the details of your purchase and correct any error (article 1127-2 of the French Civil Code). A reservation that is neither confirmed nor paid within the period ends by itself, at no cost.
5. Payment
As the artist offers you at confirmation: by card, on the secure page of the payment provider Stripe (your card details never pass through this website); by bank transfer; or in person at handover. The work remains the artist's property until the price has been paid in full. A receipt is sent to you as soon as payment is received.
6. Shipping and handover
The work is carefully packed and shipped to the address you gave, in France and abroad, with a tracking number; or handed over in person at the agreed place. The shipping time is given at confirmation; failing that, the work is delivered no later than thirty days after the sale (article L216-1 of the French Consumer Code). The work travels at the artist's risk until you receive it (article L216-4). Shipments outside the European Union: import duties and taxes may be charged by the destination country; they are payable by you. [TO BE COMPLETED: shipping insurance, usual delivery times.]
7. Right of withdrawal
You have fourteen days from receipt of the work to withdraw, without giving any reason (article L221-18 of the French Consumer Code). The simplest way: the “Withdraw from the contract here” page, linked at the bottom of every page, or your “Track my reservation” page; you immediately receive an acknowledgement of receipt by email. You may also send any clear statement by email to leguern.nassera@gmail.com. You then return the work within fourteen days, in its original packaging if possible. [TO BE COMPLETED: are return costs paid by the buyer (default rule, article L221-23) or covered?] The refund, including the initial (standard) shipping costs, is made no later than fourteen days after your withdrawal; it may wait until the work has been returned or proof of dispatch provided (article L221-24). You may be held liable if the work comes back damaged by handling beyond what is needed to examine it.
A work made to order, to your specifications, is not covered by the right of withdrawal (article L221-28, 3°).
8. Guarantees
Like any seller, the artist is liable for any lack of conformity of the work for two years from delivery (legal guarantee of conformity, articles L217-3 et seq. of the French Consumer Code) and for hidden defects (articles 1641 et seq. of the French Civil Code). 9. Certificate of authenticity
Every work sold comes with a signed certificate of authenticity, available from your “Track my reservation” page.
10. Copyright
Buying a work transfers ownership of the physical object, not the copyright (article L111-3 of the French Intellectual Property Code). Any reproduction of the work (prints, publication, commercial use) requires the artist's written consent. Photographing the work in your home for private use is of course free.
11. Your data
Your details are used only to process your reservation and purchase: see the “Privacy” page.
12. A problem?
